If you have been on incapacity benefit prior to 2001? Should your occupational pension be taken into account as income when income related ESA is calculated? I thought I read somewhere it shouldn't,

Am I right in thinking for pre 2001 claimants occupational pensions where disregarded for the transition from IB to ESA(CB) but then are included in the calculation when the same claimant moves after 365 days to ESA (IB)? If this is the case does the ammount of tax the claimant was paying when in receipt of ESA(CB) and Occupational pension drop if ESA (IB) is refused? This is a veritable nightmare

The disregard applies only if your pension was disregarded under IB and while you are in receipt of ESA(CB) as a continuous claim.Cracker wrote: Thanks Hardyyards,

If you are moved to Income Related ESA because you are in the WRAG and subject to the 365 time limit, then then the disregard is not carried forward, and your pension will be counted as income.
ESA(CB) is liable to tax whereas ESA(IR) is not.
