Hi, my DLA Tribunal hearing back in October was adjourned for an ATOS home medical. DWP didnt think that they needed any further evidence from Tribunal 3 years ago and wanted to leave me on LRC.

Finally I have received a copy of that report today.

My question is for Mobility. The Atos prof has recorded that I shuffle, have to hold on to furniture,have muscle wasting in my legs (have ME) and would not make it more than 25m. Putting to one side its DWP, would this be enough for me to possibly have a chance to obtain HRM?

Will decision be sent back to Tribunal to make or once they see evidence to support what I have always told them will they review?

There is no specific distance defined in regard to higher rate mobility for DLA, but it is generally accepted that if you cannot walk more than 50m then you should be eligible, so the report would suggest that you qualify.

It is possible that the DWP, as a result of this new report, will find in your favour before a new Tribunal hearing is convened, but it would be more normal for a Tribunal panel to make a Decision on your claim, a new panel should be convened in about 6-8 weeks.
