Hi

After my WCA a several years ago, I was placed in the ESA support group.

My condition is a combination of psychotic disorders (for which I see psychiatrist) and physical problems for which (for which I see a physio from time to time)

I take medication for both conditions i.e. anti - psychotics and anti - depressants & painkillers with side affects.

Since then I have completed several ESA 50's and have not attended any other examination, and thankfully remained in the support group. I additionally receive DLA low rate which is valid until, 2015.

In my recent ESA I have mentioned the fact that I have developed asthma, and use an inhaler, and now also use a walking stick. Additionally I and have been issued a mouth guard because of my shaking (to stop my teeth from grinding.)

I have yet to hear about my recent claim.

Will the new regulations enacted today (28th) affect my claim this time around or in the future?

Really worried but I would appreciate an honest answer so I know what to do?

Hi a94,

It depends on whether a decision has already been made and you have not yet been made aware of it. (Pre 28/01/13)

If the decision has already been made, it will have been under the pre 28/01/13 ESA Regs.

If the decision has not yet been made it seems that it will be made using the post 28/01/13 ESA Reg Ammendments.
