hi i just thought i would drop in and say hi and thanks for the advice on this forum and the guides this has helped me win my appeal, i didn't now what to expect and was very anxious especially after being dropped by my welfare adviser, if it wasn't for the reading up i did on here on sending in my medical evidence and photos i believe i wouldn't have been successful,

however it has a bitter sweet ending as i was only placed in WRAG group and with the 365 day rule my entitlement has ended and i am not entitled to income related ESA,

if i can ask some advice though due to time it took to get to appeal i ran a month over the 365 days, was i entitled to the assessment rate ESA until my appeal was heard?

Hi H1,

Sorry your post seems to have slipped through unanswered. :)

On the information that you have given, once you had exhausted your 365 days entitlement to CB ESA even at assessment rate, your payments would cease.

You could still request a supersession/review even if you are only receiving NI Credits, if your condition has deteriorated or changed to such an extent that you would qualify for the SG.

If this was the case, and you did request a review as above, and were placed into The SG, your CB ESA payments would be reinstated, and remain in payment for as long as you remained in The SG.
