DLA appeal GL24 ???

I am not happy with a medical report from a so called 'Atos medical professional' which took place in August 2012. I have told DLA that the report is lacking on information that I told the Atos Dr about but he has not recorded on the report. Because of the very poor report, omitting important information the DM does not have to go on thus not awarding any care. Is a TRAINING medical Dr allowed to write such reports ???
By a poor Report I mean things like typical day , only wrote about morning until tea time, no mention of my night time panic attacks which i need help for 20-30 mins .
He has missed my name and NI number off several pages. He states I was well kept and casually dressed when I was still in my pj's and had my dressing gown on. I could go on all night picking faults with it !!
I have informed DLA about this but yet they still use it to make a dicison. I have now to appeal using a GL24, Do have to go through every reason why I don't agree or can I simply say the report is unreliable due to the lack of information, but also tell them about the care I need during the night
I have been awarded low rate mobility, but only after a GL24.
I have asked for a list of DM reasons and also asked if they will phone me to go over the med rep, but as of today none have been done.
I am fed up and tired with it all I don't have much energy left and I now have received a ESA50.
I am in the support group of ESA CB. I though the 365 day limited did'nt apply in support group ?
distressed and confused any insight to what I NEED TO DO much appreciated.

I will try and answer your questions.
If you have a problem with the report then you need to make a complaint to ATOS, not the DWP, see
Complaining to ATOS Healthcare
As far as I know this is also the address for DLA based complaints.
I have to warn you that it is unlikely that the DWP Decision Maker will dismiss the ATOS report unless you can show that there are significant errors in it, unfortunately, the problems you have identified, are much more likely to be seen as the norm.
You do not have to go into detail on the GL24, providing that you intend to provide a more detailed submission later on, but in either case, whilst it is important to hi-light any inadequacies in the medical report, you will win your appeal by showing that you meet the criteria for DLA.
Whilst it is not impossible that the DM will contact you by phone, I think it unlikely that they will.

With regard to your ESA query, you are correct that while in the Support Group, the time limiting of ESA(CB) does not apply, but that does not mean that claimants in the SG will not be re-assessed on a regular basis.

The letter I got with the ESA50 it Said that I was being moved to ESA from IC. But this happened ages ago.II had a medical and placed in the SG on the advise of the ATOS nurse. Do you think they have sent it in error due to the wrong information on the letter ??

You can contact the DWP, but I would be surprised if this is not a scheduled re-assessment of your claim, the longest period between re-assessments is three years for the SG, and even that is quite rare.
Unless you have written confirmation from the DWP that you do not need to comlete and return this form, then you should make every effort to do so by the date on the covering letter sent with the ESA50, failing to do so could affect your claim.

Thanks for your recent reply, I phoned the benefits office today and eventually spoke to a lady (after 25 mins waiting on hold) about the reason for the ESA50 form they sent and she said that because I have been receiving CB ESA whilst in the SG for 6 months and that they are moving me to IB ESA. I really dont understand ! I asked her that because I am in SG there was no time limit to CB ESA SG. Why are they changing me over ???
so I have got only Saturday and Sunday to complete the ESA50 and post it Monday. Has Steve finished the guilds for ESA claims both physical and mental ? also the points scores for each question with the discriptors for the support group ? Is it true that I can only claim based on one of the either physical OR mental and not both, ??

I am afraid you have fallen foul of the DWP Call Centres's all to often, misinformation.
There is no requirement for you to be re-assessed in order for you to be moved from ESA(CB) to ESA(IR), more importantly, you should not be moved unless you have specifically requested it.
So, I think the reference to your being moved to ESA(IR) is just BS.
However, I am still of the opinion that this is a scheduled re-assessment of your claim.
