i have a esa tribunal hearing at {mod edit for privacy of OP} this wednesday 20/02/2013.i have also made a claim for the first time for dla would it be helpfull to tell the tribunal i have a claim for this or not.i am still however waiting for a descision as dla have wrote to my neurolgist for further infomation.it has also come to light after reading the descriptors very closely the hcp stated i never informed my gp of bladder incontrinence or loss of consiencesness yet in a leetter from my gp it clearly states incontinence problems along with blackouts and vagueness.i find this hard to believe the hcp at atos said my gp had no lknoledge of this.
any advice i would be greatfull.
thanks kell13

Hi K,
The fact that you have applied for DLA should not have any bearing on your ESA Appeal.
If you have evidence that contradicts the comments made by the ATOS HCP regarding blackouts and incontinence, then you should draw reference to this providing copy of the contradictory evidence.
As it is only two days until your hearing, you should take along 5 copies of this referenced evidence to the hearing,(one copy for each member of the panel, one for yourself, and another just in case there is a DWP Presenting Officer present, which is not a common occurance) Give this fresh evidence to The Clerk as soon as you meet with them, and ask him/her to present it to The Tribunal Panel for consideration.
Good Luck.

Let us know how you get on.

There are only two members on an ESA Tribunal Panel, not three, as with a DLA Appeal.
