Hi there, I have never used a this type of messaging before. Don't really know who will see it. Anyway if there is anyone out there I just wanted to know if you are put in the support group for a period of time then put into the working group does your 365 days contribution based ESA start from when you are transfered or is it that the days in the support group are included. Hope it makes sence, thanks

Hi,
Welcome to Benefits and Work
Any time spent in The Support Group, (SG) in receipt of either Contribution Based ESA, (CB ESA) or Income Related ESA, (IR ESA) or both, does not count against your 365 day entitlement.
There is no 365 day limit to entitlement of payment for as long as you remain in The SG.
If any part of your ESA payments are IR ESA, then again there is no 365 day limit to payment, no matter which group you are in, SG or WRAG.
If you are placed into the WRAG, in receipt of CB ESA only, then you only have 365 days entitlement to payment, before payment ceases. You may then be assessed to see whether you can pass the means test with regards to household income, savings, assets and capital, to see whether you are entitled to IR ESA.
To answer your specific question, as long as you have not been in The WRAG before, in receipt of CB ESA only, (As the 365 days are added together cumulitively, which could be from different periods of being in the WRAG) then your 365 day entitlement clock will not have started ticking until your recent entry to The WRAG.
See :
12 Month Limit for ESA(CB)
12 Month Limit for ESA(CB) – Implementation
24 hour work rule for ESA(IR)
Asset rule for ESA(IR)
Pertaining to being in The WRAG :
Work Focussed Interviews
Work Programme
Changes to ESA Sanctions
You can of course appeal if you feel that you should be in The SG, see :
Appeals FAQ’s
ESA FAQ’s
ESA Claims Guides
