Please please help advise me, I'm sick with worry was created by Victoria Stevens
Hi everyone, I only joined this website last night. I am 29 and have been on IB for about 10 years. I was changed over to the new ESA only last december, and put in the WRAG. At the time, I had no idea what this meant, and that there were 2 groups, and I also didn't realise the bit about the benefit only lasting for 12 months if you are in this group. Then on wednesday I get a new letter telling me about the change in amounts throughout the year, and that it will stop altogether in december this year :( I am married with 2 children under 5, and we are looking at loosing almost £500 per month!!!! We will not be able to pay our mortgage/bills, and I am just sick to my stomach with worry. I wouldn't be entitled to income-related ESA as my husband works full-time (although he is not on a very high salary). I also get DLA low-rate care and high-rate mobility, but obviously this is all up in the air at the moment too.

The benefits office have advised me to write back to DWP and ask for them to re-look at my forms. I had already sent in a letter from my GP, and explained in the forms that I get direct payments and have a carer in to help me and the children 3 times a week. How on earth do they think I can go back to work??? I am concerned that the one month deadline they give you, from when you first get the letter (last november for me), will work against me. The reason I will have to give for not challenging the decision sooner, is I totally did not understand the new benefit.

I am also very confused about the fact that i've had no medical, never ever have! I've also, in the nearly 3 months since i've been on ESA, had no contact from the job centre, no work related interviews, or anything that they mention in the letters. From what i've heard from others, this is not normal???

Please help me, somebody. I'd be so so grateful. Oh I forgot to say that I have M.E, I've had it for 15 yrs, and in that time have been bedbound and housebound, and using a wheelchair. In recent years I have improved a lot, but still need a LOT of help to manage daily living.

Thank you to anyone who replies xxx

A couple of admin items first and then I will try and help you.

As you are new to the forum, you may wish to have a look at the following FAQ.

Welcome to Benefits and Work

Also, your forum name may be your real name, if you want to change this then follow the instructions in the following FAQ.

My full name is showing, how can I stop it?

As you were transferred from IB, you will have been placed on Contribution Based ESA and as you are in the WRAG, there is a 365 day limit on your payments, after which your husband is expected to support you (Government phrase, not mine).

The time limiting of your payments is not an appealable Decision, and even if you could contemplate working, you will not be eligible for JSA as you will not be able to meet the Contribution requirements for JSA(CB) and the JSA(IR) has the same restrictions as ESA(IR).

The time limit does not apply to members of the Support Group, so;

If you believe that you met the criteria for the Support Group when you were transferred from IB, then you can appeal the Decision to place you in the WRAG, you will need to explain why you are making a Late Appeal, ooutside of the normal one month allowed, however, the DWP usually accept these without query.

If you do not believe, that at the time of your transfer you should have been placed in the Support Group, but due to a deterioration in your condition, you now do, then you can ask the DWP to re-assess you.

Please have a look at the following FAQs and if you have more questions, please reply to this topic.

Is there any risk to challenging a decision?

How long do I have to appeal?

How to submit an appeal

Do I have to attend WFIs while I appeal?

Thanks Gordon. I did notice that my full name was displayed!

What do you think about the fact that I've had no medicals or work related interviews etc??? No contact at all!

I was aware that I need to try and get transfered into the support group, it's just how to go about it, and how likely I am to be successful. M.E is such a tricky one on these forms :( I did the self-test to see if I qualified for SG, and I didn't, so that isn't a good start!!!! But I'm sure that I must be entitled to go into the group, given how poorly I am.....

It's such a frightening prospect to be in a position of having no means to work to gain income, and possibly loosing hundreds of pounds a month that you've relied on for years :( Shit shit shit! Already the stress has made me iller, and it's only been 2 days...

Unfortunately, it is not how poorly you are that will qualify you for the SG, you will only be placed in the group if you meet one or more the SG descriptors.

We have members who have been successfully placed in the SG with conditions such as ME, so it is possible.

Please have a read of the FAQs I have posted and the guides I have hi-lighted in my previous post.
