On page 5 am I correct in thinking that if I suffer from a back condition due to an assault as well as depression and anxiety as a subsequence of the assault I enter both the physical and mental details in the box where it asks about your illnesses or disabilities?

Hi C,
The new ESA Reg ammendments state that they will not take into account limitations regarding mental health conditions, if said mental health conditions are only as a result of a physical condition, and vice versa.
Similar with side effects suffered as a result of having to take prescribed medication.
However, my best advice would be, to mention all the limitations that you suffer physical and mental, it is upto ATOS and The ESA DM to correctly interpret the ESA Regs.
As I said to another member recently, "let them pick the bones out of it".
Further, if you have a clinical diagnosis of "depression" and you are receiving medication for this, you should mention this also.
Worse case scenario is they will not take these limitations into account, if you don't mention them in The ESA50, they cannot possibly take them into account.

Going up or down two steps
I can go up and down two steps but this activity increases and intensifies the pain I experience in my lower back and legs therefore should I tick No, Yes or It Varies ? I know how important it is to tick the right box despite putting an explanation below.

You need to download the form to your PC, where you can fill it in and then print it, but yes, this can be used instead of the form you have been sent.
Please make sure you download the correct version of the ESA50 as there are two in use at the present, one date 03/11 and the other 01/13.

Any activity that causes you severe discomfort, or worse, should be ignored for the purposes of the assessment.
