My problem may seem a little out of the ordinary but please bear with me. I have been on DLA since 2008 and my last claim was due to run out on 7 feb 2013. The DWP sent me a new DLA application pack which I filled in and sent back. Within a fortnight I received a letter telling me that I had been awarded DLA at the highest rate for both mobility and care and that it would be reassessed in Feb 2015. As you can imagine I almost fainted when I read this letter. My question is this, can I trust that the DWP really have given me my DLA for the next two years,or is this some kind of trick. I can't ask the DWP as I am afraid to bring myself to their attention again. I also haven't a clue if this means that I am no longer in the WRAG group or am in the support group. I would be very grateful if someone could hazard a guess at where I might stand.

Hi rt,

Congratulations !!!!! :woohoo:

If you have it in writing from The DWP in the form of an official Decision Notice letter, then you can take it as read. :)

This DLA award will not alter your current ESA award.

However, as the qualifying criteria for DLA, especially Higher Rate for both components is much stricter than ESA in some respects, it may help in your future reassessments of ESA.

You may wish to request copy of any medical reports etc that were used in coming to this DLA award decision, as they may well be helpful in the future, see :

DLA Medical – What forms to ask for?

You can request these in the form of a SAR by downloading one from this link :

www.dwp.gov.uk/docs/request-for-personal-information.rtf

From this page :

www.dwp.gov.uk/privacy-policy/data-protection/

You should be able to rest easy now regarding your DLA until circa the start of 2015, when you should be invited to claim PIP.

You can not be reassessed now until at least 12 months after your current award, ( unless your circumstances change) and that could only happen under :

The Right Payment Programme

You may wish to start familiarising yourself with PIP in preparation, see :

www.benefitsandwork.co.uk/help-for-claimants/dla/#pip

www.benefitsandwork.co.uk/personal-independence-payment-pip

www.benefitsandwork.co.uk/forum?view=top...id=10&id=85481#85481

In the short term, relax and take a well earned rest.

Well done, and thanks for letting us know.

Hi rt,

There may be another plus to your HR Care Component Award.

If you were not previously entitled to MR or HR Care of DLA, as you do not say what your previous DLA award was, you may now be entitled to Disability Premiums.(DP's)

This would be dependent on your personal and financial circumstances.

You could contact the DWP Benefits Office that deals with your ESA, and send them a copy of The DLA Decision Notice, telling them that you wish to be assessed to see whether you are entitled to DP.s in the form of IR ESA top-up.

You would probable have to provide details of your financial situation in the form of an ESA3 form :

Sample ESA 3 Form

This would have nothing to do with assessing you with regards to which ESA group you are in, WRAG or SG.

See : Sending Documents to the DWP or ATOS
