WRAG Appeal - further evidence??? was created by janek
I was recently transferred from IB to ESA and placed in the WRAG. I appealed this decision and requested copies of the evidence used by the decision maker, using the advice from your guides.
I have now received an acknowledgement of my appeal which asks me to send further evidence - the letter states that the decision will be looked at again, but gives no time scale as to how long this process will take nor a date by which my submission should be received; my request for copies of the evidence used has not been acknowledged or referred to.
Should I attempt to put my case again without having any idea how their decision was reached, and if I do so, will it have any impact if I later have to appeal? Also, was I wrong in assuming that my previous history (old claim forms & medicals etc from the last 16 years) would be used in reaching the decision, and if so should I send a detailed history of my conditions, stressing that it is back-up information and not the basis of my appeal?

Hi 'janek',
I will answer your last question first - You should treat every reassessment as if it were a new claim and include all relevant history and evidence. Whilst DWP might have information related to previous claims, you should not depend on it!
It is impossible to predict how long the reconsideration might take. We have heard members who have been notified within just a few days whereas my own reconsideration took 6 months. All we can advise is to get your reasons and evidence in as soon as you are able, while still doing a thorough job.
Refuting the ESA85/85A will, at best, only get you another face-to-face assessment. Your appeal needs to focus on how you meet the Support Group criteria
Qualifying for the Support Group
You can always add a sentance or two saying that you reserve the right to send further information when you receive the paperwork for which you have already asked.
If you have any further questions, please come back and ask them on this thread. You will be able to find it easily in future if you mark it as a favourite now
