TERMINATING AN ATOS "MEDICAL ASSESSMENT"!

I have just had 8 1/2 days' notice that I had to attend an ATOS "Medical Assessment" last SUNDAY.

To cut it very short, I had to wait over 1 1/2 hours to be seen, with no update as to what was happening, nothing to help support my back (which I had recently hurt - nothing to do with my Assessment) and then faced the rudest ATOS "Health Care Professional" that I have met, to date!

From the beginning she was abrupt, robotic and talked over me. Initially, she just wanted one word answers, such as "Yes" or "No", and she became impatient when I COULD NOT answer her questions to her satisfaction, (as I do have a problem with my memory, focus and concentration - attributed to my Depression and Anxiety, according to my Dr).

I asked her why she was speaking to me in such a way, and she advised that she was not obliged to carry out this "interview", and that the reason that she was running 1 1/2 hours late was due to people like me being slow to answer questions, or not answering them sufficiently. (Still keeping calm,) I said that the Defence in a Court, where I was a Witness once, spoke to me better than how she was speaking to me.

She slammed her file closed, and said she would not continue the "Assessment" and walked out the door.

Incidentally, in the 20, or so, minutes that I spent with her, she asked me about my diagnosis IN 1994... , and the form that she seemed to be referring to was one that I filled in in JUNE 2013!!!

I genuinely felt that I was being discriminated against due to my mental health issues, PLUS she should not be allowed to deal with people at any level.

I have now been given another date for 3 weeks' time.... In between Sunday and now, I broke down, could not leave my flat, ran out of food - when I did actually try to eat something. She had put me back tenfold!!

You can make a complaint to ATOS about how you were treated, but I need to make you aware of the following.

Complaining to ATOS Healthcare

- ATOS are required to give claimants 7 days notice which includes the time it takes for the appointment letter to reach the claimant. There is no restriction on appointments being made on a Sunday.

- A waiting time of 1 1/2 hours is unacceptable but I am afraid is quite common.

- The assessor is entitled to curtail the appointment if they believe the claimant is threatening or failing to participate in the interview, it may well be your word against theirs and I think it likely that ATOS will side with them on this matter.

I appreciate that none of the above will seem fair and to a considerable extent you will be right, but I think you need to choose the battles that you fight. :(

The most important thing you need to concentrate on now is your attending this new appointment, as it is likely that should you fail to do so that ATOS will return your file to the DWP and your ESA claim may then be closed.
