Hi, I am currently completing my renewal form for DLA. In January of this year I saw a specialist who offered me an operation on my spine. I thought about it and decided that the risk of making it worse was too great, so I didn't go ahead. The specialist said that if I change my mind at a later date or if it becomes impossible to cope with my back problems I can request to see him and look at it again.

As I have refused the operation at the present time, is it worth adding this to the renewal form?

There is no good answer to this, you did not have the operation so there has been no opportunity for it to affect your condition(s), as such there is no reason for you to include the information, however, if the DWP contact your Consultant for more information and they mention that you refused the operations then this may raise concerns as to why you have not mentioned this in your renewal form.

If you do mention it then you will need to fully explain why you refused the operation, you'll need to cover the chances of success versus the risk of failure and what you could have won or lost if you had had it.

I am afraid you will have to decide which option you choose.

We are advising all DLA claimants whose claim is being renewed to ensure that their forms are returned to the DWP before their current award ends and that at the least they have certificate of receipt (Recorded Delivery, etc.) or better still, that they also confirm with the DWP that they have the forms. If your forms are not returned on time, your DLA claim will be closed and you will have no choice but to claim PIP.
