Son had his PIP assessment yesterday at the ATOS Blackburn center.

Assessor, a Nurse, went through the assessment including discussing every Descriptor that we believed was relevant to my son's claim.

EXCEPT Descriptor 13 which she said did niot apply because it was only concerned with "COGNITION".

Is this a misunderstanding of the latest DWP guidance on descriptor 11 (Mobility 1) or am I being cynical thinking it is a deliberate attempt to disregard the descriptors 11b or 11e.

I believe my son woulds be awarded points from oneof these descriptors

I did not feel it was appropriate to discuss the actual law with her but I now expect to get Nil points for Descriptor 11 so I expect that my son may get 8 points for Descrpitor 12 so will not be awarded Enhanced Mobility.I believe that what we said in the PIP 2 concerning Descriptor 11 would at least have been awarded 4pts for 11b or possibly 10pts for 11e.

If he gets any award at all I will probably not seek an MR/Appeal because the whole episode was quite stessfull for him and standard rate Care or Mobility will be a passport to retain ESA when he commences University In September.

Son received his PIP decision today.

Scored no points at all just completed MR request with Mandatory Reconsideration in red capitals and larger than font of rest of text.

We also received a copy of sons latest WCA assessment. requested about three months ago.

This has evidence for the mental health elements of ESA & PIP so have quoted LC v The Secretary of State for Work and Pensions (DLA) [2015] UKUT 0032 (AAC) which is about referring to ESA assessment for DLA consideration.

One question the ESA WCA award says son has 15points but added up he actually as 21points,
do DWP stop counting when the magic 15 is reached for ESA WCA ?

The requirement for a WRAG award is that have scored 15 or more points, there is no requirement (for a WRAG award) to check any further once the 15 points acquired.

Sons Tribunal scheduled for this afternoon.

Just received phone call from FTT. Hearing adjourned until they have obtauined furthermedical evidence.

Question?
will FTT send to me and DM copies of Med.Ddocs they obtain?

Yes, you should receive copies from the Tribunal Service as soon as the information is available and in advance of the hearing being re-booked.
