Hi
I am hoping you can help me.
My brother has returned home from Holland after living there for a number of years.
He has terminal cancer. Is their any benefits he and the person that is loking after him can claim.

Yes.
He can claim ESA and PIP.
whether he gets them will depend on his circumstances. Hopefully he can use all our guides to help him fill in the forms correctly and stand the best chance of success.

Hi p,
Just to add,
On the premise that he has no problems satisfying : The Habitual Residency Test (which we do not advise on)
As advised, he can make a claim for PIP and ESA.
If his Terminal Cancer prognosis is for 6 months or less, and he has entitlement, his PIP and ESA claims should be fast tracked without the need of face to face assessments. etc.
This should result in a Support Group Award for ESA and at least an Enhanced Daily Living Award for PIP. (Maybe Enhanced Mobility too)
If his prognosis is for 6 months or less, you need to get his Consultant or G.P. to fill out a DS1500 Form, and send copy to DWP ESA and PIP.
This being the case, you should inform The DWP from the onset, that the ESA and PIP claims are under "Special Rules", they will then ask that you provide copy of The DS1500.

If he receives a PIP Daily Living Award, you or someone else may be able to claim : Carers Allowance for providing at least 35 Hours of care for him.
On the premise that a PIP Daily Living Award/ESA Support Group Award is made, you should ask CAB or the like to do a Benefits Check for him, as it is not always best financially for someone else to claim Carers Allowance which can mean that he may lose entitlement to payment of "Disability Premiums".
If the prognosis is not 6 months or less, he can still claim ESA and PIP but will have to go through the normal assessment procedures.
Although, receiving Chemotherapy does give some priority.
Macmillan do have Benefit Adviser who can help with ESA and PIP Claims for Cancer sufferers.

I have been told that you have to be in the uk for 2 years before you can claim PIP.
