:( My husband and I are bemused as to why our government are guided and agree to most eu rules which benefit other countries but are allowed and do flout eu rules regarding our own people who are disabled.
I have worked over 40 years full time since leaving school at 15, my husband has worked over 35 years full time.
Just over 4 years ago I was taken seriously ill and was left paralysed on my left side and other disabilities, since then i have been unable to work and will never work again. I now have artheritis which exacerbates my other problems. My husband has degenerative joint problems and is in and out of hospital so he too is unable to work now.
I am 63 and on higher rate care and mobility, my husband is on lower rate care and middle rate mobility.
Our problem is this, we want to go and live in a warmer climate which helps both our conditions. We read online dla is transportable by eu ruling, yet our government refuses to abide by this.
If we go to live abroad they will not allow exportability of our benefits or permit us to be treated like for like at gheir hospitals.
Surely this is wrong!!!!!

I'm really sorry but we don't deal with the exportability of benefits on the forum, the best I can suggest is that you contact your MP.

Hiya,

Sorry I have not replied sooner but I have been unable to.

Re exportability.
DLA Care component only, you automatically loose your mobility component.
However even DLA care has now been withdrawn for exportability.

PIP no exportability in any area.

ESA SG you used to be able to export, even when changed from IB, however that has been withdrawn.

IB exportability, cancelled.

No other benefits exportable apart from Industrial Injury Benefit, however for how long!!!?

One used to be able to complete a form via your GP provided by Social Services/Job centre to be sent to the Secretary of State, in which you said and the GP etc saying you would benefit from living in a warmer climate thus reducing GP/Hospital apts and medication etc.

However when the new Benefits came into effect they removed this permission to move abroad.
Thus those on the old benefits (IB/DLA) who were living abroad and receiving the older style benefits agreed by the Secretary of State, presumed when they changed over to the new Benefits ESA SG, PIP, this would continue.
They received a rude awakening as they were informed this was No longer the case.
They had to return to the UK in order to receive ESA SG, PIP and were given a 3 month reprieve to do so, otherwise all benefits would cease and they probably would not be able to re submit forms to qualify as they had been living out of the UK.

Stuffed was not the word for it.

No one refuted the new legislation or put up a song and dance as there were not enough people to do so, so it went un-noticed and became legislation.

Pretty much the same for pensions and women changing from 60 to 66 plus, no one shouted or stood up to the fact when it first reared its nasty head until it was too late.
I did yell loud and hard early in its conception but was a lone cub amongst many bigger Wolves who had the upper hand.

Because we do not advise on the exportability of benefits we do not get much feedback, if any, on how people have got on with this. I think the thing to take away from this topic is to contact the DWP and see what they say, these Decision will carry a right of appeal.

I suggest you follow the route I explained in an earlier post I sent you (3 days ago ) wherby I listed the the regs from the migrants manual, which in all tense and purpose you become when moving abroad.
