DLA to PIP refusal, depression and anxiety. Appeal

Hi, I received the dreaded letter today, and even though I filled in the forms with help from this site I was still refused. I used to get higher rate care and lower rate mobility on DLA and was awarded this indefinitely. PIP have given me 2 points out of the whole assessment. They even had to do a home visit as my anxiety gets so bad I can't leave the house, yet apparently the assessor only noted mild anxiety! I was so anxious I was visibly shaking and crying. I was physically sick before she came out and for days before and after I was a wreck. I just don't understand the decision.
I know I have to put in a mandatory reconsideration before I appeal, I just wandered how I go about collecting evidence. My mum has to stay with me 3-4 nights a week. She has to batch cook for me and will look after my 2 boys. I have friends who sometimes have to take my son to school as I can't leave the house. My ex husband steps up for the children when I'm having a bad time. I have a lot of emotional support and people that help me get through. I told this all to the assessor and on my forms but all of that seems to have been ignored. How would my mum/ex husband go about detailing evidence to send with my appeal. Thank you so much. Any help or info is greatly appreciated.

Sorry to hear this.

PIP is very much about dotting the "I"s and crossing the "T"s and it easy to miss out on points because you have not covered all of the elements for a descriptor.

I'll give you some information about requesting the MR and get more information from the DWP, once you have that we can look at how you might score more points.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Once you have the assessment report I would suggest you go through it with your PIP and our PIP Claim guide to see where you need to explain your limitations in more detail.

In terms of more evidence, it would be worth your speaking to your GP to see what assistance they can provide.

If you have questions now or when you receive the assessment report then please reply to this post and we will do our best to help.
