It's up to the claimant, as yours is relatively old and does not represent how you are now then you might not want to include it bit for others who have had their DLA assessed recently or have conditions that are not likely to improve then it might make sense to include it.

1,Regarding whether to say use old information from a Dla claim the person had severe anxiety and depression and the only evidence he sent was a short note from a psychiatrist stating this. He cannot remember whether the Psychiatrist wrote on the form or a letter. He now has Fibromyalgia Fatigue ( which may be part of fibro or separate to it...they can't tell him because of all the medication he takes) and still has severe anxiety and depression. He is getting a letter from his CPN to confirm that he is in secondry care and he sees him regularly.
2, Is the question when you call for the PIP1 part "How would you like us to contact you...BY phone or by letter" a kind of trick question? He wants to say by phone as he struggles to get downstairs to pick up post ( I call round and pick it up when he is there but he comes to my house in a taxi for a few days so wouldn't be there all the time to attend to the post when it's delivered. What I'm trying to say is would the fact that if he asked to be contacted by phone count against him in regard to his Anxiety and depression? We are going to ring to start the process later today the letter says claim by 7th december Does that include on the 7th or before the 7th dec. Thanks

The claim must be instigated by the close of business on the date given. However, it is up to the claimant to take weekends and bank holiday into account. We also suggest that you don't leave it until the last minute in case there is any unexpected hold-up.

She was also quite forceful in trying to get him to let them use his old DLA claim for the PIP claim to which he eventually said no as his illness had got worse and he now had physical illness as well as psychiatric and didn't think the old letter of support would be relevant. He claimed DLA about 8 to 10 years back. She asked if he had a psychiatric illness that he had been hospitalised for and he said yes severe depression but hadn't been in hospital for a long time. He told her he had a CPN. After she told him that the PIP2 would be sent out she then said that "someone would phone him in the next 14days to gather more medical evidence" Is this normal? that they phone you up to gather more medical evidence 'BEFORE' they have even received the PIP2 from back? Please advise as we feel they are trying to trick him and he now feels suicidal. Thank you
