Supported protected people Esa Pip council was created by Skintmember22
Hi I'm sorry to come yet again...
I'm just confused about my esa /pip protection status dates
I was awarded standard daily living and enhanced mobility

My husband was then advised to make a claim for carers allowance he made a claim for carers after pip decision

Because there was some confusion between Esa department regards who was paying what as DWP had almost made the esa decision while himself was trying to claim carers
I have been informed by the council that our protected status would start
ESA 26/2/16 award started 04/03/16 + 13 weeks afterwards

We need to show the support group award to council to to backdate our council tax support this didn't add up but was told they were waiting esa to decide who was paying what

PIP 14/09/16 Previous protected status
CARERS awarded starts18/09/16
first payment of 31/10/16 £ 62.10
2nd payment (day after) 01/11/16 £ 125.10
07/11/16 £ 62.10
14/11/16 £ 62.10
On the 14/11/16 I received my support group award along with back pay of £1335.61
Limited capacity for work
support group component x23 weeks
Disability income guarantee x23 weeks
I may be getting ahead of myself here
Am I right in thinking but if I'm in the protected group after 13 weeks and claimed pip was I due a disability premium from the 14th week of £34.60 up until himself started claiming carers

I received a letter the other day from esa hull
That goes through my claim in detail
I received the same letter 3 days later

Living expenses for you and your partner £ 114.85
+Money because your partner is a carer. £ 34.60
+ Money because of Disability income guarantee £ 22.60
+ Money because you are in support group. £ 36.20
Which gives you a total income related amount = £ 208.25
It goes on to say pip daily living is not counted
Pip mobility is not counted
Carers allowance for your partner Less - £ 62.10
Giving you an income related amount of = £ 146.15
I'm so sorry if I'm this isn't the right place to ask someone if not would yiou point me in the right direction thanks again and apologies it's really niggling me since Welfare rights emailed me yesterday xx

Many Thanks Cx

Forgive me but I am really not sure what you are asking for.

The date of the Support Group award should be on your Decision letter, if you don't have one then contact the DWP and ask for one.

The DWP should have notified your Local Authority electronically of your ESA and PIP awards so I'm not sure why they do not have the information already. Issues of what should be paid should not be relevant to your situation as these are secondary to the award being made.

You mention a Disability Premium not being paid until your partner claimed CA, the only Premium that CA would prevent the payment of is the Severe Disability Premium and as far as I can see you are not eligible for this anyway.

If you can explain further then I'll try to help.

Many thanks for the reply Gordon,
do you not think I'm entitled severe disability premium.
I'll try explain...

am I actually getting any disability premiums
are they the
support group premium £36.20 is this the single rate
The disability income guarantee £22.60
Are these the disability premiums too
If my husband hadn't claimed carers allowance in September/October
Would I have received more backpay i.e. would I have been eligible for the severe disability premium backdated from the 14th week which was 23 weeks vs 5 weeks carers allowance Do you know if carers allowance department would backdate the claim from the 14th week <support group
Do you know if himself could even claim backpay from carers allowance for or being in the support group.
Thanks a lot xx

To be eligible for the Severe Disability Premium you must live alone or be considered to be living alone.

As you have a partner you obviously do not live alone. You will only be considered as living alone if the people living with you are all classed as Dependants (this does not apply to a partner) and/or they also receive a qualifying benefit, e.g. DLA MRC or HRC, PIP Daily Living or Attendance Allowance.

As far as I can see your partner does not receive any of these benefits.
