Hello to al the lovey members and hardworking Moderators (apologies if I'm posting at a wrong place. I had my ESA Tribunal today and WON. Thank you all moderators for your help and the lovely site. Need to sleep on it and then start getting advise about PIP:) :)

I've moved your post to it's own topic.

Well done on the Tribunal result.

It normally takes the DWP 5-8 weeks to process a Tribunal Decision, I would ring them at the end of the week just to make sure that they have received the Decision Notice from the Tribunal Service.

Will do Gordon. I can sleep on it now. This site has changed slightly I'm having problem finding my own posts and to comment in the right place so I'll play around with it. As I need to prepare for ATOS interview I was suppose to go for an assessment out of my are 40 miles away but when I rang them they gave me appoint just 2miles away from my home but my GP has requested a home visit so I cancelled the assessment for Monday they said they will get in touch me but said they can't guarantee a home visit the operator said only if I was getting home visits from my GP but I mentioned section 19c to them lets see what they say until then need to visit the guide on this site

Dear Moderators,

I clicked on my name which is next to welcome I hope I have done it correctly.

regarding my appeal yesterday which was allowed. I was awarded 15 points under schedule 2 and 3. They have put down 'appellant not to be reassessed. can you tell me what does this mean please?.

Dear Moderators,

I had a letter for PIP assessment which was 40 miles away from home I called them up and asked for one nearer to home which they gave me but yesterday after my esa appeal I looked at the GP's letter which has requested a home visit. I therefore rang Atos again for a home visit he first of all couldn't find the letter then mentioned a doctors name I never heard of. He kept me on hold then eventually found the letter and said he will cancel the assessment on Monday and they will get back to me. He said that home visit is only if I am housebound and if I get home visits by the GP so I read out about Equality act and section 19c of the UN Contravention of Rights of Disabled people. He didn't say anything and said somebody will be in touch I have left it at that for the time being. Can I ask can they refuse a home visit even if the GP has strongly recommended a home visit after giving all the health issues on the letter. I think he was trying to make me feel that I will not get a home visit and I will have to go the centre. It was just a bit of advise I was given yesterday at the Tribunal by someone (not anyone on the panel)
