Pip appeal - ESA now changed to JSA was created by tam payne
Hi
I'm currently awaiting a date for my tribunal to appeal my PIP claim which i scored 0 points. When i had DLA my partner had careers allowance and i had ESA. When my DLA ended i informed the DWP that my partner was no longer receiving Careers allowance. I received a letter today asking me to go to a appointment to my local job centre on 18th May to go through a job seekers agreement. It seems that they are changing me to JSA, I'm not fit to work and currently receiving treatment from the mental health team. Can they take me of ESA and put me on JSA? i do not want to be sanctioned but feel like giving up. My partner is so stressed and this whole business is putting a huge strain on my marriage. I just want to make sure i do everything correctly, if anyone can advise me on what i should do. (Do i accept going onto JSA and how do i explain my medical conditions when i go for the interview, I don't want to be pushed in agreeing to something that i wont be able to keep too and than get my benefits stopped.

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
My full name is showing, how can I stop it?
The DWP cannot just move you to JSA from ESA, so something has to have happened with your ESA claim that you have not mentioned in your post.
ESA and JSA are mutually exclusive benefits you can only claim one of them at a time, so if the DWP are saying that you need to claim JSA then this can only be because your ESA claim has stopped.
