Any help would be great,. My wife won her apeal in court for esa and would not be reacesed for two years ,she has not had any money from them for two years does this mean that she will start to get money again or is it just that she will not be reacesed. This court decision was back in 21/03/2017. She did not have to appear in court due to her anxiety and depression. Any help would be appreciated.
Have you confirmed with the DWP that they have the Decision notice from her appeal as I would have expected you to have heard from the DWP by now.
You don't say what the award was? If it was for the Support Group then she should definitely expect to receive some back pay. If it was for the WRAG then it may depend on any time she has previously spent in the WRAG and whether she would be entitled to Income Related ESA or not, but I would still expect some level of back payments in the vast majority of cases.
