My client has just lost a PIP appeal. My query/concerns are:
(1) the fact that the chair turned down my client's request to consult notes (separate from the submitted bundle) she had brought with her - an aide memoire -to help answer an questions because one of her chief symptoms is forgetfulness. She was instructed to just answer the questions put to her. Is this a potential breach of natural justice so grounds for an appeal to the upper tier tribunal under that category?
(2)Also both of us found one of the panel members very hostile in demeanour , who presented very intimidating questioning /counter questioning the likes of which I have never encountered before - more like an interrogation with seemingly irrelevant lines of inquiry resulting at one point my client bursting into tears. Obviously I cannot go into the detail here but is this also grounds for an appeal to the UTT?
