Confused about my Appeal outcome was created by amandajane
Hi all
I used the brilliant guide on here as a member, best £20 I’ve ever spent, thank you.
I won my ESA Appeal yesterday, but don’t understand what the outcome will be. I was given 6 points for mobilising and 9 points for sitting & standing, total 15. Judge said :’You’ve won’ and letter said I am significantly limited, but no mention of Support Group, but she did say I’ve got 12 months with no WCA. I’ve had ESA at Assessment Rate for nearly a year, and would not qualify for income-related due to husband’s wage. DWP were useless on phone & told me to wait 4 weeks. Does anyone know whether I’ll get anything, or will my ESA stop after 52 weeks ? TIA for anyone’s help or experiences

The 15 points qualify you for the WRAG.
If you are not entitled to ESA(IR) then your ESA(CB) will only be payable for 365 days if you are not in the Support Group, you will still receive NI Credits that count towards a Full State pension and your not receiving payment for your ESA claim means that you cannot be required to undertake Work Related Activity.
You should still receive back payment of the WRAG component.
It normally takes the DWP 5-8 weeks to process a Tribunal result, I would give them a call to make sure that they have received the Decision Notice.
