Forgive me, I've been searching everywhere and am sure that at my last assessment time there was something somewhere with regard to FLUCTUATING CONDITIONS?

ESA does not define this directly this, it is specified in Case Law and is taken as the majority of the time, this is the majority of hours in a day, days in a week, etc.
However, if you can show that you have Limited Capability for Work either at the beginning of the day or at some time afterwards then you should be considered as having LCW for the rest of the day. Regulation 27 of the ESA Regulations 2008.
