PIP questions. was created by sini@keilty.co.uk
Hello Gordon,
I am not sure where I can ask a question on this forum because I have never done it before.
My apologies if it appears in a wrong place.
I am trying to help my daughter with her PIP. Previously she was receiving it at medium rate because of BPD mental health issues but after she had an assessment interview before Christmas, it has been taken away. Zero points!
There are some inaccuracies in the short report but can they be corrected and would it make any difference? It was said that her circumstances have changed, and she doesn't qualify. Her circumstances have changed, but this is because she has just been diagnosed as having scoliosis. But there is no mention of this at all, although she suffers much pain etc because of it.
Could it be that because she manages to work full time, they have decided she doesn't need extra help? I am trying to find out about 'Mandatory Reconsideration'. Is it worth while, or would a completely new application make better sense? I am totally new to this kind of paperwork, and hardly know where to begin. Steep learning curve for me.
I need to try and help my daughter because she is just too exhausted after her work day to manage anything.
Thank you for this forum and other web info, where I can begin my learning.

Kind regards,
Sini

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is

Welcome to Benefits and Work

I've moved your post to its own topic, we ask members not to post their questions in other member's topics as it can lead to the wrong advice being given or taken. You can start your own topic by clicking on the New Topic button.

Her working full-time will certainly cast doubt in the minds of those who assessed her as to whether she meets the criteria for an award.

Is the working new? Was she working when last assessed?

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
