Hi
My son is on ESA in the support group. He's in receipt of PIP, standard care, enhanced mobility. His wife claims carers allowance.
She is now wanting to end the carers allowance claim and end the relationship.
Can anyone explain what the procedure would be in this case?
Would he be able to get back his disability premium or would he have to claim universal credit.

All she has to do is to contact the Carers Unit, the contact number will be on the letters she has received about the CA, she should follow up the cancellation in writing, preferably by a Tracked post so that she has proof of delivery.

Once payment of the CA stops your son can contact the DWP office dealing with his ESA claim and ask for the Severe Disability Premium to be put into payment, this requires him to complete an IS10 form, it may be possible to do this over the phone.

Adding the SD Premium is an amendment to his existing ESA claim, it will not trigger a transfer to UC.

If the marriage does end will that trigger a change in circumstances and therefore having you claim UC?

No, there needs to be a requirement for a new claim for one of the benefits that come under UC, this would not be the case for your son, everything is an amendment to his existing claim.

I might not have explained fully but ending the marriage would mean she will move out. Wouldn't this trigger UC?
