Providing you have not already spent time outside of the Support Group with the exception of the original Assessment period providing you were put straight into the SG, then you are entitled to 365 days of ESA(CB) payments.

I would contact the DWP office dealing with your claim for an update.

Don't worry about being contacted about Work Related Activity, it's not unusual for them not to contact ESA(CB) claimants until the 365 days are up and they can see whether the claimant qualified for ESA(IR).

Hi Gordon

Payment finally came through and i am starting the process of going to appeal, but it will take time to get reports etc from my Consultant, GP, and further MRI . Also i should be getting a decision on a standing MRI scan of my spine within a week or so, ( has to be funded by the NHS) as the only MRI scanners which allow scans to be taken standing upright, are in private clinics.
So it would be possibly be a month or so until i have all the info i need to forward to the appeal tribunal .
Can i just inform the Tribunal further evidence will be supplied as soon as possible on the SSCS1 form. I have already been informed that i must attend an appointment with a work coach this coming week, i advised him by phone that it will cause me severe pain and suffering to attend the meeting, he basically replied with you must attend. I asked if they would cover a taxi from the bus station approx 1.5miles. no they wont. so apart from enduring a 60mile round trip, i also have to get myself likely by bus to the Job centre. absolutely stunning uncaring attitude.

If you have opted for an Oral hearing, that you attend, then you can submit information for the appeal up to about two weeks before the hearing, if it is a Paper hearing, that you do not, then all of your testimony and evidence must be with the Tribunal Service no later than one month from the date of the letter accompanying the DWP's submission, you will receive a copy of this once your appeal is accepted.

You don't have to notify the TS that you will be sending additional information.

Thanks again Gordon. I will be opting for a Oral hearing. I have also arranged a meeting with CAB who have said they will help with the process as it's stressing us out no end at the moment.

Just an update (Gordon)

Appeal sent with support from CAB. Attended initial work coach interview.. To be fair to the guy he recognised the pain i was in, and certainly no where near fit to even carry out wrag group f2f interviews. Said he will note on my records and plans only a telephone call in 6 mths.

Update, Appeal Officer has revised their decision, and i am now back in the SG. Many thanks to Gordon, and this great site for all the help and advice. One quick question, will this now be a longer period before re-assessment as they were going to review in 6mths?
