Hi, I would like to ask for some advice on moving forward with my first PIP appeal.

I have epilepsy and was awarded 0 points after my Capita home assessment...I live in NI so I’m not sure if most are home based.
I requested a MR and sent in a lengthy letter as evidence to support my claim further and to explain any inconsistencies I felt were in the report.

Exactly 4 weeks after I sent my letter to the DFC I noticed a sum of money in my bank account from PIP. I called for more information and was told I had been given 4 points for daily living but enhanced mobility.

At first I was willing to accept this, thinking that my letter that I put everything into was simply not enough to support my claim for daily living.
Today I received the MR letter with the explanation for not awarding me daily living. It was clear from the wording the DM used that they just looked over the assessor’s report again and not looked at my letter at all. Which is probably the reason such a short waiting time.

So I am pretty fired up about this, it took me almost 8 hrs over 2 days to write that letter due to my medication making my brain all kinds of fuzzy sometimes!

Finally getting to my actually question.... I requested the appeal form today and wanted to know if I can ask just for the daily living to be looked at as I am happy with the mobility part or will they want to go over the whole claim?
Realistically and going by the self testing I would be happy with standard rate daily living as I feel how my epilepsy effects me would not warrant enough points for enhanced. So I only need 4 more points.

Also does anyone from NI have any idea how long tribunal waiting times are?

Hi Shellh78

You need to say in your appeal that you are satisfied with the mobility, but it will not stop them considering your entire claim. So make sure that you have look at the risks of going for an appeal before you decide to do so.

I'm afraid we don't have a view of waiting times for appeals in Northern Ireland, although I am aware that appeal rates in NI are higher than the mainland so this is likely to mean an increased wait.
