  			 				I have recently been told that my Housing Benefit and Council tax claim has ended because of an increase in my income from a private pension and the lump sum I received is over £16,000  which I understand is correct, but during a conversation with someone at the Council benefit office I was told that as soon as I start to receive a private pension my ESA claim would automatically change from income related to contribution based.  I am still working age, have 35 Years paid contributions and I have been credited  while claiming ESA  so I would obviously qualify for Contribution based. ESA.  My query is that I have also been receiving another private pension since before my claim started in 2015 of £84.00 per month.   I got Contribution based ESA for 52 weeks and put in the Support Group with the disability premium BUT have had £19 per week deducted for that pension income since the claim started?  Is this correct or should I have been put  on contribution based ESA where I am allowed up to £85 per week pension and lose 50% of anything over that?  Could it be that my ESA is made up of income related and contribution based - how do I tell?

To be eligible for Contribution Based ESA you must have met or have been considered as meeting the Contribution Conditions when you made your claim for ESA, you cannot become entitled to ESA(CB) after your claim started, so do you know whether this was the case for you?
 
If it was then you can receive ESA(CB) with an Income Related ESA top-up.
 
A pension of £84 per month would result in a deduction of £19.60 from your weekly ESA payments., providing this was less than the ESA(IR) that you receive then the extra ESA(IR) would be payable. If it was more then you would only receive your ESA(CB).
 
If you are only receiving ESA(IR) then having savings in excess of £16,000 would prevent any payment of your ESA irrelevant of what pension income you have.
