I've been on ESA long term for physical and mental health issues. I don't spend much as I don't go out much and have no dependants so the money just accrues in my bank.

I've made a schoolboy error and forgot about the 6k savings threshold, had that 16k limit in my head instead where you lose benefits. Now I'm a bit over the threshold by a couple of grand and worried what the repurcussions will be, as I'm in the middle of a new claim.

What might happen to me and how should I avoid this happening again? Just spend what I get?

From your previous posts, you are receiving Income Related ESA, at least in part so the £6000 limit applies to you.

The first thing to say is that you should not sit on this, it will only get worse with time.

Notify the DWP office dealing with your ESA claim of your current savings and when you first went over the limit. The deduction is £1 for every £250 or part thereof in excess of the £6000, so you need to get your current payments sorted out and then there will be a recoverable overpayment, at the moment the DWP should not attempt to receiver this money but they will once the current crisis is over.

Obviously, your savings have built up over time so it might help you to work out what the overpayment might be so you can confirm it against the DWP's figures, as a rough guide you are probably looking at an average of £4 or £5 per week since you exceeded the limit

Are the DWP too busy to deal with it at present?
As an aside how long should you be waiting for a decision after an assessment? I had mine about three months ago, well before the lockdown and subsequent big uptake of UC etc.

Are they too busy? Possibly but that does not mean that you can wait until they aren't.

You can phone them but you must follow up in writing and if possible use a Tracked post so that you have proof of delivery, if needed.

I still haven't done anything about this, mainly because I am waiting for my ESA decision and have been for many months.

Should I sit it out until I am informed of my ESA decision? Why is it taking so long? I appreciate the backlog but it's almost four times longer so far than I was told it would be to wait.

As Gordon previously advised, this is not something you should sit on. You need to try and contact the DWP and then follow up with a letter in writing.

Regarding how long your ESA claims, there's nothing we can offer you here as to why they are taking so long. They had a backlog before the COVID crisis and it has only got worse. The only thing to do is to contact them and get an approximate time for your area.
