Affect on joint ESA if 1 person goes into hospital was created by Anna
My partner and I are on a joint ESA claim as we both get disability premiums. It is likely that one of us may have to go into hospital for a few months. We are concerned what will happen about our money as the other person will still be living at home hence requiring money to live. Can you give us any advise on this please?

Although it is often referred to as a joint claim it is not, one of you is the claimant and the other is part of their household.
It should not matter which of you goes into hospital, the ESA payments should continue but the claimant will need to notify the DWP when it happens.

I know it was a while ago I brought this topic to the forum, but the situation has come into play now. I've been admitted to hospital but my partner is still at home. As I think I said before we were both awarded the SDP but when our claim became joint, it was put together.
When I rang ESA yesterday to inform them I've been admitted to hospital but my partner is still at home they tried telling me that we would both loose our SDP as well as me loosing my PIP. This is a massive drop in our income and we are really going to struggle with bills etc and keeping the house. I don't understand how me being in hospital could mean he will also loose his SDP. They have said they'll get someone to call me back to clarify things but I wondered if you could give me any advise or whether you know anything about our rights in this situation? Sorry to bother you again. Thank you in advance

First of all, payment of PIP awards are suspended, the actual award remains in place as long as the claimant continues to meet the criteria.
There is no suspension for the first 28 days in a hospital or a care home. You must contact the DWP if go over the 28 days, the days you are admitted and discharged do not count towards the total, or there will be a recoverable overpayment.
After 28 days the Daily Living component is suspended if the care is being funded by the NHS or the Local Authority. It is not suspended if the claimant is fully funding their care.
After 28 days if the claimant is in a hospital then the Mobility component is suspended.
ESA can sometimes continue to be paid indefinitely without being reduced. However, the disability, enhanced disability and higher pensioner premiums in income support ( and any premiums and additional components in income-related ESA) are stopped after 52 weeks.
If your PIP stops, it will be paid again as soon as you come out of hospital. If you come out of hospital but have to go back in within 28 days your benefit will stop again as soon as you are staying in hospital again.
