pip question for new claim was created by NICKY SHEPHERD
Hi All
I am having my third intervention for pip due to severe back problems. I first applied after I had a directory and decompression after being diagnosed with candia equine. After the op I then had a major cfs leak where I had two tears that needed repairing. I got my first award which was standard care and no mobility. After a few months due to my back problems which reoccurred I had to give up my full time job as my employer would not let me go part time.
I then put in another intervention using this site and providing massive amounts of evidence and worked for weeks on my application. I then got my assessors app which was and hour and 15 mins away. My mum drove but I was in a huge amount of pain. The assessor did not look at me the whole time just typed away at her computer. I refused to do leg movements as I was in so much pain. Any way to cut long story short she lied through the whole report. Used the fact that I didn't let her do leg movements and my award ended up the same. I suffer with depression and anxiety due to me having to give up my career she even twisted that and said I couldn't be as I do not take medication for it. I dnt take any because I am on twenty tablets of high pain meds and I can not take alot more as they do not mix. This whole process took 10mths to get this result.
I have now had to ensure another operation to fuse my back but have now been left with minimal mobility. Have to use a crutch ,can not stand or walk for more than 10 min. Yet again I have spent weeks trying to fill yet another form in .. to then await for an assessment.
Please can anyone give me any guidance or help that might help me get what I need.my husband is my main carer who washes and dresses me etc. Cooks all meals housework etc.and goes to work full time.
I am at my witts end with it all. Also advice on other help.
Thank you.

Hi Nicky
I'm not sure from what you say, exactly where you are in the process. I understand you put in a claim and were awarded standard care and no mobility. I don't know whether you put in for a mandatory reconsideration after this decision or you later put in for a change of circumstances, or you had a normal PiP review.
You clearly had another assessment (which was the long drive) - but now you say you have been filling in another form. Is this a review, or a change of circumstances?
If you have already put in the form, I don't know what I can say to you which would be very helpful at this stage. Have you a letter from a GP or any other medical professional about your difficulties - backing up what you're saying? Not all GP's issue them. Did you include a letter from your husband, detailing the difficulties you have and what he has observed which are relevant to the PIP criteria? It can be helpful to do this.
The DWP do tend to get fixated on what medication people take, and it is a sometimes crude tool that they use to justify their decisions. Unfortunately, it is on the claimant to counteract it and probably only a GP's or Psychiatrist's letter will help with this.

Hi Bis
Thank you for reply. I am just about to send of again as this is change of circumstances. My husband did supply letter last time and also my gp did a recommendation that I should be given full pip. I felt that last time no one even looked at my extra information at all. It seemed that what the assesor put they went by . I am really fed up with it all as really need to get this.
I am not sure what else I can provide. My spinal consultant said she could not give me a letter but if they contacted her she would be happy to support my case.

Have you reviewed our PIP Claim guide?
So you have a Standard award, is that for both components or just one?
You are reporting a Change so have you identified where you would score the extra points and explained how you meet the criteria for then?
I'm concerned, in your original post you said you could not walk for more than 10 minutes, someone walking very slowly would easily exceed the 200m that PIP considers as a maximum! If you have said this on your claim form or to the assessor then this could easily exclude you from scoring for the Moving Around activity.

Hi
Thank you for your reply. I have standard only for the care did not get anything for mobility.
Yes i have gone through and identified where I need to extra points and clarified this.
The walking for no more than 10 minutes would be stopping a lot and sitting down. I will look at this part again to try and clarify it more as I would be in a huge amount of pain to do this. I dnt go out as I do not have wheelchair so it would be a problem for me if I couldnt sit down.
Do you have any other advise ? I really want to get it right this time .

Hi Nicky
You are really going to have to be clear about the walking. If you stop, how many times are you likely to stop? How long does it take you to recover between each stop? What are your pain levels like at this point?
Be very careful that you don't contradict yourself. If you do go out - how often do you actually go out? Because you've said above that you don't go out - so that could easily paint a confusing picture. If you only go out for hospital appointments then say so. You don't have to say so on your form but be ready to answer if asked why you don't have a wheelchair.
