New Style ESA and Carer’s Allowance was created by HarryD
Hello, a bit of a long question here. I receive enhanced PIP both rates. I was self employed and worked from home. My spouse helped me with physical help in my work, which enabled me to work from home. I received Carer’s for looking after my spouse and we jointly claimed working tax credits. My spouse was retired.
My spouse died last month and the WTC has stopped. I cannot carry on working without the help of my spouse. My illness prevents me from working outside the house. I did not earn a lot of money and was only credited with national insurance credits from the carers allowance. I have used entitled to Website and I am not due any Universal credit.
What I wanted to know is would I be entitled to contribution ESA or new style ESA as I believe it is called from reading articles? I read an item on entitled to stating having Carer’s credits and the rules have been relaxed regarding the 26 weeks of other credits if you received WTC with the disability element immediately before your limited capability for work began.
Does that mean the day before your limited capability for work began?
I would appreciate your opinion.

For each week you were entitled to claim CA you get a Class 1 National Insurance Contribution Credit. Carer's Allowance credits help meet the contribution conditions for any contributory benefit, such as NS ESA.
Carers Credit: you get a Class 3 credit for each week in which you:
Are caring for one or more disabled people for at least 20 hrs a week and either they get a qualifying benefit or a health or social care professional has certified that the care you provide is needed. The credits can continue for a period of 12 weeks afer you cease to meet these conditions for any reasons.
Are entitled to income support as a carer.
You also get these credits to cover 12 week period before or after an award of CA.
If you have at least 50 weeks of NI Contributions in both of the Tax Years 2017-18 and 2018-19 then you can make a claim for New Style ESA.
If you are awarded Limited Capability for Work then the NE ESA is only payable for a year, if you receive Limited Capability for Work Related Activity then it is payable for as long as you meet the criteria.

Providing you;
- paid Class 1 or Class 2 Contributions before the relevant benefit week in respect of any one Tax Year

Thank you. Would I need something from my doctor to say I was unwell to be self employed anymore? If so what is it called and what would I do with it please?

You will need a Fit Note, you send a copy to the DWP once you have applied for New Style ESA.

My spouse had a private pension and it hasn’t been sorted out yet. It wasn’t a lot of money. A portion of it will be payable to me now. Will that be taken into account with Contribution ESA? I read that any personal pensions are deducted from ESA.
