Rules re PIP and ESA was created by Au-Rain
If a person who was renting has to move out of County without knowing if they can find suitable rental property
(They also had HB PIP and ESA )
Would they be legally safe and legitimate to temporarily stay with friend who receives ESA and PIP and use it as CO address without jeopardising both themselves and friends benefits ?
How long would they be allowed to stay ?
Would this affect the owners council tax and would you have to inform council re this ? The owner is exempt from CT
Thanks

If you notify the DWP that you are now at another address then they will take it that you are living there!
You could live there for a couple of weeks without notifying the DWP without it being a problem although it exposes you to missing any letters that they send you but the longer that you do the more likely that you will be considered to be living there instead of visiting.
If you or your friend are receiving the Severe Disability Premium as part of their ESA then you/they will be required to notify the DWP if you stay for any reasonable period, if you both have a PIP Daily Living award then it should not impact on your payments.
Your friend's Local Authority may expect you to contribute to the rent and reduce what they receive accordingly, they may not require this but I cannot state this for certain.

Ty
I just find this by chance
The friend would not be paying rent at temp address as the person owns the house and do as favour till they find rental property

The issue that you need to avoid is the DWP treating you as a couple, I appreciate that you are not but you may struggle to show that as there will be no legal documents that separate you from your friend.
As I said, a short term stay will be OK but the longer that you are there the more chance that the DWP will take action.
