Lcwwra to lcw with a couple of weeks was created by Pictish66
Hi
I wonder if anyone can help
I received a letter in my uc journal on 3rd of Nov saying that following my wca it has been decided that I have lcwwra .
Two weeks later I asked why I haven't received the 6 months back payment and why it hasn't been added to our uc payment.
A few days later there reply is that it was a mistake and I have only been awarded lcw.
I really am at my wit's end with them .
Any advice on how I should proceed now.
Is that legal to effectively take an award away even if they claim a mistake

Hi Pictish66

Mistakes are made, the first thing you need to do is ask for a copy of the assessors report called UC85A ( I assume it was a telephone assessment), contact the UC helpline Telephone: 0800 328 5644. Once you get the assessors report you will then be able to see where you failed to meet one of the necessary descriptors or exceptional circumstances rules to be placed in LCWRA group.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our UC MR & Appeal guide for details of the process, I usually use a form called CRMR1 www.gov.uk/government/publications/chall...ork-and-pensions-dwp, I believe there is a template letter in the members only guide section.

Remember, In order to qualify for the LCWRA/Support Group you need to;
* meet one or more of the relevant descriptors, or
* meet one of the associated Exceptional Circumstances rules.

The LCWRA/Support Group descriptors and the Exceptional Circumstances are listed in the Claiming ESA guides in the members area.

Hi thanks Gary
I requested the wca report the decision makers report lt54
And the uc 113
Today I received the wca in the post ,it has no reference to me by name ,even the envelope only has my address on it .
Anyway it's 7 pages long but pages 1 and 7 are missing.
The report states that I meet the criteria for lcwwra.
Taking into account questionnaire ,med3 ,frr4 ,113 hospital correspondence and poid2.
I am missing the lt54 and 113
I've no idea what an frr4 or a poid2.
Any idea where I stand with this as it seems the hcp has said I meat criteria but no explanation as to why dn has disagreed .
And where do I stand regarding the missing documentation .

How did you qualify for the SG?

The DM is not required to follow the recommendation of the assessor but if they don't then they need to explain why they haven't, this would be on an LT54.

The list of evidence may be a copy/paste we regularly see this with ESA/UC. The FRR4 is completed when the assessor has telephone contact with someone in regard to your claim, the POID2 is about the identification you provided.

If a Decision has been made then your only way forward is via an MR.

I don't know how I qualified for sg in the first letter.
How do I find this out as the letter only said that I qualify for lcwwra.
A few weeks later they changed it to lcw

The first letter I received said I was getting lcwwra
Second said I was getting lcw
You asked how I qualified gordon ,I presume they made that decision based on the wca .to grant lcwwra.
How they came to the conclusion I don't meet lcwwra all they say is my questionnaire , information provided by hcas(wca) and other info I sent.
No idea there line of thinking on either of these decisions without dm report.
Come to think of it does this mean there's actually 2 reports
