Got myself a bit of a dilemma
I received text message earlier in year saying my PIP assessment would be delayed till feb 2021 but they called & kept on pressurizing me into accepting a phone assessment which i reluctantly accepted for September 6th.
The day arrives & I'm all over the place with notes everywhere , anxiety levels through the roof but feeling that I'm going to be telling the truth therefore what could go wrong!?
The woman calls asking if colleague could listen in for training which i agreed to.
The assessment lasted 45-55 mins but felt it went ok & my decision would take up to 8 weeks to be decided.
Mid October & brown envelope arrives with the bad news that my PIP had been disallowed & why!
The assessor (Health Professional, who is a physiotherapist) played with my words & lied on her assessment about several things which are easy to prove.
Example; She states i am driving every week to my chemist to collect my prescriptions in her assessment whereas the truth is i do not own or have access to a car/vehicle plus my chemist has been delivering all my prescriptions since May - Lie number 1 easily proved!
2. I can walk to the shop & do my shopping but I've been awarded 4 points for mobility issues plus suffer severe anxiety levels when around folk or in the knowledge I'm having to go anywhere (usually hospital appointments these days) And my nearest shop is over 300+ metres away keeping in mind I've been awarded mobility points because i cant walk more than 200 metres in their opinion contradicts their award & makes no sense!? (I told assessor i was awaiting my 2nd Angiogram to clear up my blocked RCA which limits my ability in walking any distance without bringing on a serious Angina attack. I also have ischaemic Heart disease established when i had my stroke 12 years ago. I've had angiogram last week & procedure now on cardiac rehab but also told i now have widespread LAD heart disease)
The list of lies are unbelievable!
She even managed to ascertain my mental state of mind from asking me if I'm suicidal , a phone call to establish my mental health!?? I have a call coming from my psychiatrist in December so when i tell him he will need to look for another profession as Capita use magical physiotherapists to ascertain my mental health I'm sure he will write or call them to explain why i suffer from PTSD & my mental state of mind is not great & hopefully tell them that physiotherapists DO NOT have the credentials or the right to tell a 3rd party about something they have absolutely no training/experience in. But that's for my Appeal .
I was furious & made a mistake of writing in anger a 9 page 2&1/2 days to write letter which is now considered as my MR (Bad move , should have read more on this site first & got letters from my psychiatrist plus Dr to support my letter)
This Tuesday i called DWP PIP to query why £3.77 was put in my account & to my surprise she tells me my claim is still being disallowed but then says "oh but you have 8 points for mobility so ill get the senior manager to sort it out & you'll now receive a lesser amount of £23.+pennies & reinstated onto PIP!" sounding chuffed with herself in informing me my rant of a MR got myself another 4 points on my mobility (can walk 20 metres but no more than 50 metres) which enables me to receive PIP but on a lower rate than before.
I asked her for the assessment report which she sounded astonished by & asked me the reason i required it? I said "Its for my appeal"
Now here's my dilemma , i know its a big risk appealing as i might lose & my PIP will be stopped which snowballs in affecting my ESA & Housing benefits but i feel my case is strong & with my supporting evidence from Professionals in their fields rather than a physiotherapists pack of lies which i now have seen with the full assessment being sent out is quite remarkable & sickening with its content , therefore in my longwinded way i need advice on what to do?
Should i appeal knowing i should score points for most of the descriptors adding to my 8 points for mobility & from my psychiatrist plus Drs professional input or should i let them away with blatantly lying in their assessment which is easily proved & bite the bullet!? Unhappy that I'm not receiving benefits I'm entitled to which is the crux of my post , I'm entitled to these benefits therefore i feel should pursue these entitlements.
Very distressing , severe physiological distress , now in cardiac rehab which by the way is not why I'm on PIP or ESA , its an unwelcome addition to all my other issues.
You Think things cant get any worse? Along pops the DWP & a physiotherapist who may i add used a very clever technique in her assessment. She used casual conversation within the assessment & applied my words which were totally out of concept with the original questions asked in her answers.
Sorry for my long post that's taken 4hrs to write , go over & check several times before i posted it.
Don't know why its taken so long as the physiotherapist thinks i can read & understand things quite easily! pffffft hope she chokes on the takeaway that i paid for with her bonus. Sorry but i cant stand liars & she has undoubtedly lied as well as twist my words to fit her own agenda...…Making money!
Appeal or no appeal??

Only you can decide whether to appeal or not.
If you have an award of PIP now then it cannot be removed at an appeal without the Judge in charge of the hearing issuing a warning to you and adjourning the hearing so that you can get advice.
How did you qualify for PIP previously?

That's good to know makes my decision a little easier.
I originally qualified for PIP through mental health conditions & what comes with it.
Diagnosed with PTSD back in the 90,s
Been ongoing battle since then but i never received many benefits over the years as i managed to keep working on & off.
My Dr kept trying to get me to go for psychiatric treatment but took until early 2000,s before my 1st CBT treatment & now on my 5th or 6th different psychiatrist
Eventually all the years took its toll & had a nervous breakdown 2014 & was at this point i started receiving PIP & ESA through my really bad state of mind.
It was actually through my psychiatrists help that i had someone to fight my corner without me really having to speak to anyone who got me in receipt of these benefits.

From your own members guide on pip appeals i came across this.
"-, i.e. you have been awarded PIP but at a lower rate or
for a shorter period than you think is correct, it is important to remember that your award can
be reduced or taken away at appeal, so you need to consider carefully whether you might lose
more than you gain. -"
could someone please verify or not if this is actually the case that if i am now in receipt of a lower PIP rate than before my assessment but unhappy & want to appeal that i could actually lose my appeal & my lower rate taken away from me which then affects my ESA rate?

It is just as Gordon wrote in a previous post.
If you have an award of PIP now then it cannot be removed at an appeal without the Judge in charge of the hearing issuing a warning to you and adjourning the hearing so that you can get advice.
What this means is that you can then have the choice to withdraw your appeal and if you do so then your award will stay at the level of your original award. This is not held against you. The judges issue this warning when there is a danger of an award being downgraded.

One more question ; I have 8 points on mobility but 0 points on daily living components 8 points due to my obvious lack of mobility from my ongoing heart problems.
Thankfully my recent procedure/operation & my now ongoing cardiac rehab seems to have relieved my angina pains/blockages but still in early stages with another procedure forthcoming.
So my question is this , if i appeal as the assessor made so many mistakes in her assessment for daily living components & on the day of my hearing i appear with the ability to walk more than 50 metres will they take this into their consideration and deduct points for mobility or is this appeal for the date of my initial assessment regardless if my mobility has improved or not?
