I have been placed in the LCWRA group for Universal Credit after a paper assessment and then applied for ESA and am currently in the assessment phase. I filled out the ESA50 form, in fact I just duplicated the UC50 form as they are the same questions.

My question is, do I need to undergo an assessment for nsESA or can they not just use the UC decision?

I've been waiting a long time for a decision from nsESA as to whether I will be in the support group or not.

Your post is some what confusing, if you have already been placed in the LCWRA group, then you will not get placed in the support group

If you are getting LCWRA then you have already had a decision for NS ESA.

New Style ESA is a Contribution Based benefit and is not means tested with the exception of pension income which can reduce the amount that you receive.

The Income Related benefit that goes with NS ESA is Universal Credit.

Thanks for your reply.

I am in the LCWRA for UC after filling in the form and having a paper based assessment; and I am also applying for new style Employment and Support Allowance (just so I can continue getting NI credits), and they have sent me a form.

From my understanding which isn't much, they both have a "support group" but from my understanding, the nsESA support group benefit can continue, otherwise if I am found to be fit for work it only gets paid for 365 days.

My question is that as I've already had the assessment and have been placed in the LCWRA group for UC, do I need to go through another assessment for nsESA? I was just asking as they are exactly the same form, just named UC50 and ESA50!

Just wondered if anybody had the answer please. Gary, you said that as I was already in the support group for UC ("limited capability for work and work related activity" or LCWRA), I will not be in the "support group" for nsESA? Is that right?

I am writing a letter to DWP so just wondered if you could clarify, as I understand that for nsESA that you are on the assessment payment for so many weeks, you have a WCA and are either placed in the "fit to look for work" so payment will only be for 365 days, and if you are in the "support group" (illness/disabled and unable to look for or do work) that you get an additional amount and this can be for an unlimited time period.

I just wanted to know if I need to go through two WCAs, one for UC which has already put me in the LCWRA group; and the nsESA that I have just sent back the ESA50 form back to DWP.

As always, many thanks for your help.

(I'm a bit forgetful and scatty, so your expertise would be very much appreciated.)

Hi Smithy

From your post you are mixing legacy benefit terminology up with UC.

New Style ESA is a Contribution Based benefit and is not means tested with the exception of pension income which can reduce the amount that you receive.

The Income Related benefit that goes with NS ESA is Universal Credit.

When you have a WCA you are placed in either LCW or LCWRA group, under legacy benefit the equivalent was IR ESA, when you had a WCA under IR ESA you were placed in either the WRAG or Support Group.

If you were in receipt of only CB ESA then you would not be able to claim certain premiums such a SDP and EDP although you could get the 'Support' element, if you received the support element then your CB ESA would stay in payment until you were re-assessed, the 365 day rule would not apply.

When you claim NS ESA you are initially in the assessment phase, this usually is for 13 weeks but we are hearing on the forum members being on it for nearly a year, there is a backlog in claims.

I am lost with the last part of your post, you say that you are already in LCWRA via UC and that you have sent back the ESA50 form. You will not get a ESA 50 if you are claiming NS ESA, if you are claiming NS ESA then the form you should get is UC 50 form although both forms are exactly the same, remember NS ESA is based on your NI premiums.
