Hello, I am helping a friend who had a PIP review telephone assessment by IAS on 18/12/2020. He requested that an audio recording be sent to him which was agreed. He has now received a decision letter from DWP which is for reduced mobility award. The audio recording has not been received from IAS despite being chased several times. He will need to put in for Mandatory Reconsideration by 10/02/2021 - is non receipt of audio recording grounds to request to DWP for an extension for receipt of Mandatory Reconsideration request ? I need to hear the audio recording to advise if he should go for MR. His request for me to be included on conference call during assessment was agreed by IAS but it never happened....

If the DWP has sent the decision letter, all papers and recordings should be available to your friend. He should also get hold of a copy of the assessment report which will give more details on how the decision was made. He just needs to ring and request this asap. Recoding interviews like this is new, but the DWP should extend the time for you to return an MR - but you would need to raise this with them. You don't have to hear the recording to put in the request for an MR - you can always withdraw it, if you and your friend decide it is not right. I would particularly make the point that the request for a conference call was agreed and not carried through. That's a disgrace.

I so agree with BIS it is an utter disgrace, please keep a diary of all this so when the dust settles you have the evidence to consider helping your friend put in an official complaint and involve their MP etc,

Thank you - I have finally managed to get through to DWP PIP helpline on phone (3 x over 1 hour on phone to get to speak with real person). I have requested copy of PA4 Assessor's report but not sure how long this will take to arrive. DWP suggested request for MR saying 'awaiting further evidence...'. I will continue to push IAS for audio copy.
I have printed off form CRMR1/01/18 but this is asking for lots of information ...maybe better to just say 'awaiting further information'??? This is complicated as my friend's first language is not English and telephone assessment was done through interpreter

I keep notes of all phone calls with DWP and IAS with names of those I talk with

Hi Cardiff2011

You can do an out of time MR, you just need to explain why you are applying out of time, there is a section on the CRMR1 form. Unless you know the grounds as to why you are requesting a MR then I would wait for the assessors report.

Once you get the assessors report go through it carefully, I usually use a highlighter and mark where it is disputed.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.
