Assessor report contradicts self and my form

Assessor report contradicts self and my form was created by nicmcc
Apologies in advance for the incoming epic.
My copy of the assessors report had arrived. I have not had a decision yet.
Checking the points (if they follow the recommendation) I'm going to lose 7 points from living so drop from enhanced to standard.
Mobility lose 4 points but still get Enhanced mobility.
I haven't gone through it all yet.
As I said on a previous post it is obvious that they have not read my form or letters, they also contradict themselves and make huge leaps from that.
They said I was fine,; I kept apologising for rabbiting on - I was anxious. I told them I was in bed propped up with pillows and had notes (apparently I didn't move or say I was in pain and needed time to move - I was moving, but I was terrified.
There is also things missing for example : in History of conditions my main condition: Generalised Anxiety Disorder (& social anxiety, panic attacks, obsessional thoughts) are not mentioned - Apart from " under the clinical psychologist from the pain team to manage pain and anxiety" (way at the bottom). This is the first thing listed on the PIP form. On the report the dates for diagnosis is wrong, when they there are on my PIP form. There is the odd throw away " anxiety but they seem to mention the depression more.
Things like my dosege box - I said it on the phone its on my form, no mention of it in the report - 0 points.
In functional history they put my partner cuts my food, (also on my form) because of poor grip & (pain) - no mention in the descriptor. Because sometimes I can use a knife & fork (sometimes, not cutting) and can use elbow crutches = I have adequate grip so 0 points ( even though their previous assessor examined me 3 years ago and said that I had restricted arm movement & power and reduced pinch & grip).
Apparently, because I'm no longer seeing the mental health team
" she is not under the mental health team which would suggest her mental health is stable." And it mentions that my meds must control my condition, because " I'm not under mental health".
That is then used on a lot of descriptors to give me less points.
I explained to the assessor and it's on my form & on my previous award.(the letters were on my last award (because -2016/17).
I stopped seeing my PCMH worker in Sept 2016, NOT because I was better but because the service no longer existed.
I was refered to another team (because my PCMH worker, said I still need care/ support). I saw that team until May 2017. I was discharged because - I was not well enough to do the work they did - my letter literally says that it's adding too much pressure to me and I can get refered back later.
My Partner took me to the GP, but I was too low to do the self referral.
In Sept 17 the pain team decided that as my physical & mental health combined to make a larger whole and nobody had tried to work on both together, that I was going to see a clinical psychologist (and pain team at the same time). To try to make a real difference and also prepare me as there is not much else that can be done for my physical issues.
So since then I've been seeing a clinical psychologist for both my Anxiety conditions/ depression and physical. ( I have letters from the clinical psychologist).
It was decided that it would be too much/ detrimental to start any other mental health input.
On the report In the History of conditions, the assessor has put: "She is under the clinical physiologist to help her manage the pain & anxiety" then further down: "she has not had any mental health input since 2017.
I know that really this is irrelevant, but apparently the person who did this was a paramedic, so they know more than consultants, in rheumatology, Pain management, mental health, clinical psychology and a nurse from their own organisation who has actually seen me.
I have a few random questions:
My first/ previous PIP award - the DWP pretty much followed the assessors report. If, as with this report it contradicts my form and the previous report, (this is a renewal and they didn't "see me") is there a chance they will notice the discrepancies? and follow the form / letters not the assessment?
Do I wait and see? If I ring up and go through the missing / inaccurate items, will that cause issues ( drag it out longer)?
Will the fact that can I do that (with support and to to detriment of everything else including, sleep and eating) be used against me?
There is an error I need to correct - I was so nervous I was trying to describe a kitchen tray trolley the OT had given me (it's written on the PIP form correctly) - but its been put down that I use a wheeled trolley to move around.
When you ask for a mandatory consideration do you still get paid the new amount until a decision is made?
If you appeal, does the original award end and you get nothing until a decision is made?

1. Most decision-makers follow the assessor's report - because the decision-maker is a none medical person.
2. There is a small window for you to write to the decision-maker and correct any errors or missing information. You could try and phone, but whether you would be put through to them I don't know. You ought to put it in writing anyway so it is on your records.
3. Will it be against you - if you try and phone? It shouldn't but I can't say categorically that it wouldn't. I think it probably depends how much you say and what you have already said on your form.
4. You can correct the information about the tray.
5. Your mandatory reconsideration - the date of which the rate changes can vary.
6. If you go onto appeal you will receive whatever award was given at the MR stage.
When you put in for your MR focus on the areas where you hope to score points. Don't get tied up on issues that won't score you points. They can always be deal with in the final paragraph of a letter.

Hi Nic, they do it over and over - you have just written a 100% transferable description of what they did on our daughter even though they were actually doing a paper-based one! Depending on the timescale, as BIS says in point 2, you might be able to write in most politely but firmly challenging the report BEFORE they do the decision. It was successful for our daughter doing so and I hope this helps encourage you to give it a go.
Basically write out what you said in your post, but section by numbered section; for each one say the Document Number [or name and date if you didn't number them] of the relevant proof document you already sent. Use cold unemotional factual language to compare and contrast what they say with what each piece of evidence says. Literally tick the lies off in pencil on the report [or a copy] as you work through drafting your letter. Also say it is NOT an MR request but you reserve the right to still request one. Hope you succeed, Denby
