Hi I was wondering if anyone could offer me some advice? I had my assessment over the phone it took 1 hour and 40 minutes to complete? I had someone in the assessment with me who was making notes. But the assessor has put that it was me making the notes whilst talking to them on the phone? Anyway they reduced my daily living from 13 points to 9 and also didn’t ask me 2 questions from that section. They also awarded me 8 points for mobility but did not ask me about planning and following a journey question? Do you think I should ask for a mandatory reconsideration please ?

Hi Sue

Have you only got the decision letter or have you also received a copy of the assessment report? If you are going to make a Mandatory Reconsideration - you need to get a copy of the report (PA4) as it will give you further details which will help you to challenge the decision.

An assessor doesn't always ask every question - sometimes they might feel that they already have all the information they need, and of course it is possible they might forget.

Only you can decide whether you want to put in for a Mandatory Reconsideration because you know your circumstances and your medical conditions, but many people who are not happy with their awards decide to do so. If you don't see any logical reason for them cutting your award - then you might want to challenge it.

You have to put in for a mandatory reconsideration within one month of the date on the decision letter.

That sounds incredibly frustrating! I have had this experience with incorrect information about who was involved in my assessment and also about what was assessed from telephone assessments of my stepdaughter and her boyfriend. I am sorry you have had this experience.

If you aren’t happy with the decision made and think it is wrong you are entitled to ask for a mandatory reconsideration. If you decide to do this it can be done via phone or in writing but seeing how easy it can be to misrepresent the spoken word it seems documenting in writing is sensible!

You can provide additional evidence for a mandatory reconsideration that support any difficulties with any of the activities assessed (or not assessed!)

If you feel you should have scored points in the activities that were not discussed in the assessment and you do decide to raise a mandatory reconsideration, it would be good to point out your concerns that these areas were not sufficiently assessed as a reason for the DWP to reconsider the decisions.

And finally if you do ask for a mandatory reconsideration and it isn’t successful remember that you will have the right to appeal this and have the case looked at by an independent panel. The success rate for appeals is very high (approx 73%) so if you were to find yourself in this position keep this in mind.

Hi Sue

If you intend to apply for a MR, it is very important to contact DWP and request a copy of the assessors report (PA4) as stated by BIS below. Without the report you will not know how the assessor assessed you.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

Thank you Bis she said I was coherent understood everything and calm throughout? I recorded the assessment and you can clearly hear I broke down crying twice? And because she could hear my mum writing notes to help me she has automatically presumed it was me making all these notes and she has used that against me in every section of the assessment report. I’ve not had the official brown envelope but I doubt it will change with it being over the phone. But thank you anyway for your response BIS.

Make sure you ask for a copy of the assessors report (PA4), try and get this before you get the decision from DWP.
