Hi,
My daughter claims ESA and receives the SDP since 2018. However. the annual uprating letter came in stating a change. It did not specify the change but was easy to work out the SDP had not been paid. I spoke to ESA only to be told she had a paid carer to which I replied that is right. I went on to tell them. I notified you on the 11/09/018 as I was making enquiries if having a Carer would affect her SDP. I said based on the information I was given at the time which I wrote down and dated, There was no reason to believe anything was wrong as the SDP continued to be paid. I have since gathered additional information towards her case and is in in her favour. However, today she received her new PIP Award and it states she had been paid too much money. I do not understand this as both benefits are separate. Any Ideas?

Hi Honey66,

Severe Disability Premium is awarded if you receive ESA as well as at least standard rate of daily living PIP. You have to live without other adults and not have any carer claim Carer’s Allowance.
Whilst it is possible that DWP thought your phone call was to say you were actually claiming CA I think this is unlikely. Perhaps more likely is that your daughter's PIP no longer has a daily living component and hence no longer qualifies for SDP. This could also explain the reduction (overpayment?) in PIP.
I don't know why there is a PIP overpayment. PIP is not dependant on ESA and you can have one benefit without the other. There are only 2 obvious reasons for a PIP overpayment: DWP award one rate, but actually pay a higher amount by mistake. This would be their mistake, and not necessarily repayable. Alternatively, if your daughter had made a mistake in her claim form, or DWP had received information that caused doubt over the full nature of your daughter's health difficulties, AND DWP had consequently made a further decision to revise your daughter's PIP.
I think you should phone both ESA & PIP departments to try and ascertain what has happened. If there has been a revision in your daughter's benefits there should be a letter, although sometimes I am aware no such letter ever arrives.
Depending on what has happened you may need to consider instigating an appeal. More information us definitely required from DWP.

Hi,
Thanks for your quick response. I am as baffled as you are. My daughter health conditions are severe and have always been supported by medical evidence. It is strange it has happened at the same time as ESA potential overpayment. As the Pip Decision Maker took into account the ESA85 medical report when making his decision. I have phoned ESA and I am waiting on the FOI request. I will be telephoning PIP tomorrow.
