Hi Chucky16993,
An interesting question. If you are serious that they have really written about another person they have been very naughty. If they have identified the person concerned or given enough information about them to be able to reasonably identify them there is a breach of the data protection act aka GDPR. It is important that you do not reveal this information to any additional person. You should at the minimum write to the DWP and inform them of their error and request that they remove the wrong material from the bundle of paperwork. You could additionally report the matter to the Information Commissioners' Office. This email address is being protected from spambots. You need JavaScript enabled to view it..
If however the information is not identifiable you should simply write to the DWP and request that they amend their report.
The other option, and I am not clear from your post if this is the case, you may feel that the report has been written about someone else because it is such a poor representation of you and the issues you have with Daily Living and Mobility. If this is the case you need to read our guides and work out what aspects of your life you wish you to draw to the attention of the Tribunal Panel.
PIP resources
The Tribunal is your chance to present the realities of your life, and your chance to refute what may have been written about you in the report. Remember it is best if you can not only 'this is not true', but say what is true, and ideally present evidence of that.
I hope this answers your question, if not, please do come back to us.
