Don't know what to do. was created by Susie27
Hello mods,
I need a bit of advice re my partner potentially coming to share my 1 bed flat with me.
I am on DLA middle rate care and standard mobility. I get ESA Support Group both Contribution and Income related which obvs includes the SDP. I also get full housing benefit.
My partner (who would be moving boroughs) receives PIP Enhanced/enhanced, Suppport group, again both contribution and income related as well as housing benefit.
If I was to put him on my tenancy, would we continue to receive legacy benefits or would we need to make a joint claim for Universal Credit as a couple?
I know there are no premiums with UC and I expect that we would not qualify for transition payments because this is not classed as a natural migration? Am I right?
Finally, I know we would need to inform the DWP but would that mean we would both be reassessed for both ESA and PIP (or the UC equivalent of ESA Support Group)? I am worried that if we went on to UC we would have to start again with claiming LCWRAG?
Many thanks for all that you do,
Susie

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Susie
Don't worry about your post appearing twice. I've deleted the other one.
Unfortunately, you need to talk to a specialist benefits advisor as it is outside the scope of the forum to advise you on housing and what would be the impact on your benefits if your partner moves in with you. They will be able to tell you what to do about your tenancy agreement and explain the different options in terms of your claim. Your ESA will be affected because you will be a household and will not be able to claim the SDP which is for people living alone. Your PIP would be unaffected.
You really do need to go through it with someone who is a specialist in this area. Google for specialist benefits advisors in your area.

Hi Susie
It would be classed as a change of circumstances and you would have to apply for UC, from the 27th January 2021 the "SDP Gateway" was removed.
Contact your local Welfare Rights Worker to help you with benefit entitlements advicelocal.uk
You can check your benefit entitlement by putting your information into one of the online benefit calculators.
