Hi!
I had a paper-based appeal yesterday as I wasn't able to attend due to Botox messing with my migraines horrendously.

The decision has been made and sent out and somebody from DWP called today about the decision. I had made a new application after sending the appeal because I wasn't sure whether I would be awarded anything by the tribunal judges. They have, however, awarded me enhanced mobility, but few points on daily living that don't add up to an award.

I'm aware that my application was weak in Feb 2020 but my conditions have worsened now and they're having an increasingly debilitating effect on my daily life.

DWP called and told me about the decision and also said that the new application would have to be cancelled, which is understandable, and that if I didn't agree with the decision then it would moving forward with an intervention, but I'm not sure what that means.

Preferably I'd like to accept the award but then report a change of circumstances in regards to daily living, but then I'd be at risk of losing the mobility award, right?

I'm confused and just stressed with what to do because I think the tribunal made the right decision, but know that the effect my conditions has on my life now stretches further than that.

Any information as to what an intervention is or what my options are in simpler terms would be appreciated!

Hi Dottie

A tribunal will only look at your condition as it was when you were first assessed by an assessor, they will not take into account your condition now if it has deteriorated since the assessment.

As you rightly say you will need to apply for a change of circumstances.

If you report a Change then you should do so in writing as the date of your letter will be used to set the start date of any new award, Ideally, send it using a Track'd post so that you have proof of delivery.

Before you report a Change you should be certain that you would reasonably qualify for a higher award, not all deterioration or even new conditions will result in your scoring the points you need for a higher award. See our PIP Claims guide for the criteria that you will need to make.

If you report a Change then you will be sent a new PIP2 to complete and it is almost certain that you will be required to have some sort of assessment.
