Someone I know is going from SSP and will be getting payment from work as occupational sick pay over £140 - they have been told that as the pay is being given with no paid work, it should not make any difference to Cont ESA and they can get the two together.
I thought it was wrong as it is over the permitted work amount, but if it's not paid work is it possible I'm wrong?
You question is quite complex, we can not give you a definitive answer as we do not have enough information. For a definitive answer you will need to contact your local welfare rights worker who will be able to take all your information into account. I will try and give a overview to what I believe you are asking.
If you are still sick at the start of your 23rd week of your period of entitlement to SSP and likely to remain sick beyond 28th week, you may claim UC and/or NS ESA. Your employer must complete and send you a form called SSP1.
If you receive an occupation/personal pension including personal health insurance payments that pays more than £85 a week then your NS ESA or CB ESA is reduced by half of the amount over this limit, for example if the receive £140 a week before tax your ESA is reduced by £27.50 a week, i.e half of the excess figure of £55.
