Guidance for PIP decision makers / MR questions

So, the decision on my PIP arrived yesterday, and it took my PIP from me. No surprise, as the telephone assessment was appalling - bad line, she spoke with a very heavy accent, and didn't seem to understand or listen to what I was saying, constantly interrupting me.

I've applied for a copy of her report. It seems very unfair to claimants that the DWP now say the claimant can't be sent a copy of the assessors report till the decision is made (what I was told this time). I have a month from the date on the decision letter to make my mandatory appeal, one week gone before I even received the letter, and probably another week or two to get the report.

The other thing I noticed about the decision makers rationale for his decision was that several time he used phrases like "you report xyz symptoms, but you do not have a diagnosis of xyz". I could be wrong, but I'm sure when I prepared for my (successful) appeal last time I read somewhere that decision makers had been directed that a claimant did not need a formal diagnosis of for example CFS, or to be on medication for depression to get points for difficulties related to those symptoms. Is that correct? If so, could anyone direct me to the guidance so I can quote it?

Hi Jane

You were misinformed by the person you spoke to when you requested your PA4 (Assessors report) that you could not have it until the decision is made. This is untrue although people are often told it. We have plenty of members even in the last few weeks who have had their forms before the decision. If it happens in the future - don't try and argue - just put the phone down and ring again and hope you get a call handler who knows the rules.
