DO THE DWP HAVE TO LISTEN TO ICE??? was created by ANGELA
Morning. *CAN SOMEONE PLEASE OFFER ANY ADVICE/ HELP??*
I have had a joyful time over the past 2 years taking a DWP complaint through every single stage of the process, followed by more of the same with ICE.
Eventually ICE told DWP to revisit my DLA claims 2010-2014 & my first PIP claim in 2014 in regards to my MOBILITY payments.
EVERY ESA (Support) decision since 2010 has been made because of my ‘inability to mobilise’ yet I didn’t receive any Mobility Payments until 2016, when I was awarded Enhanced PIP Mobility at tribunal. The evidence they used was my ESA84s & LT54s since 2010, which I received through a SARS request by a PAID advocate.
I phoned up today (not heard a thing for months), and was told that ICE’s request was ‘outside their remit’, WTAF…..
The DWP are ‘resending’ a letter they allegedly sent me in September stating this, & will inform ICE I am not impressed.
DWP were asked by ICE to make a ‘Revision Decision’ and have basically said ‘NO’.
I will continue to be a pain in the A and will continue with ICE and write to the Ombudsman.
Are they allowed to ignore ICE????

I'm sorry, but your question is outside the remit of this forum. I can't tell you whether the DWP are forced to accept the recommendations of ICE because it doesn't say one way or the other on the government website. I think you should contact ICE and ask them.

Hi Angel,
wow, wow, and wow. I thought I'd had a rough time with husbands MR and ignored evidence!
If they can completely ignore ICE then what's the point? Surely to goodness the whole point of it is that it has some power to make them take notice otherwise its just a complete waste of time and money.

Hi Angel, I just want to wish you power to your elbow. Without people doing the sort of thing you are doing, and then reporting on it so advisers can quote the precedent when you succeed, there would be a lot less justice done!!! Best, Denby
