I received my letter from the DWP with their decision on my award. They have given me the enhanced rate on both Daily Living and Mobility, but only for 4 years. I had a phone call just last week from someone in the DWP wanting to just clarify3 points, which I did and he said he knew looking at my conditions that I would never get better and these conditions would on,y get worse with age, he stated he would " give me the award for as long as was legally posssible". So to get this today with on,y a 4 year extension leaves me absolutely devastated. My new conditions included Fibromyalgia, Cervical Spondylotis, Epidural Fibrosis and Arthritis. Can anyone suggest my best course of action.

Hello Mildred,

How frustrating and disappointing. Assuming that the decision you are speaking about was the first one, that is it is not the result of a Mandatory Reconsideration or an appeal, you could request a Mandatory Reconsideration on the basis that you agree with the award, i.e. enhanced on both Daily Living and Mobility, but disagree with the length of the award.

A Mandatory Reconsideration does open up the theoretical risk that you could lose some of your award, but I have only heard of that happening in a few very exceptional cases, and I have never come across it. If it did happen you could then take that decision to appeal.

Do you have supporting evidence that your condition will not improve,? (However obvious that may appear to be.)

Only you can decide if you want to have the fight now for an extension to your award or have the fight in four years time when it comes to a review.

Thank you Catherine for your reply.
I have been on DLA/ PIP SINCE 1995, so as you can see I have several problems, which I included in the form along with these new ones.
He even states in his decision that the information I provided shows my conditions cause me great difficulties. Then he ends the decision saying the reason why he has given me a "set time" is because my "needs may change". Well if the only way they have changed from 1995 is for the worse.
I just can't get the DWP to understand I will never get better.

Hi Mildred… I’m sorry this has happened to you. It does seem to be a bit arbitrary how they decide these things. I too have just heard back and was awarded E/E for 6 years… though I had asked for a ‘longer term award’ ie. leave me alone…
I have the same with ESA(Support)… I meet the Severe Conditions criteria (ie.. not going to get better & E/E) but will prob be reviewed again for that in a couple of years, despite requesting that I be exempt from future ones…(not going to magically get better).
I am taking my award and sticking with it, as it a great relief. When I am due for ‘renewal’, I will have been receiving PIP E/E for ten years… maybe this is what they are after… the ‘golden ticket’.. to being given a ‘light touch award’..
They don’t seem to count DLA in PIP history for some reason..
Obviously I don’t know when you moved to PIP, but if the ‘end’ of your new award period matches up to you having then been on PIP for ten years, it may just be worth waiting, and then using the evidence of ‘ten years E/E to back up future stuff.
Totally your call obviously, and I understand your anger and frustration..
