I complained about my sons DLA to pip transfer assesment and the assessors report.
My complaint was upheld and the report recalled from DWP as not fit for purpose.
Now DWP has sent out a declining pip based on the assessors report and has stopped my sons DLA payments..
They have said there is nothing I can do until he is reassessed but could possibly do an MR..
The assesment services have said it can take a while to get a recorded assesment..
What should I do... An MR on a report that has been recalled.
Or wait in poverty until I get another assesment date?
So stressed and confused.

I'm sorry this has happened to you. That is appalling. I'm afraid I only have a couple of suggestions and I'm not sure whether they will even work.
1) Ring the DWP and say that you want a call back with a case manager to discuss the decision. You are entitled to this. You don't want to speak to a normal call handler as they will only repeat what they see on the screen. You want someone with more seniority that can tell you why the decision is made. Obviously, you then ask why you are being penalised and why his DLA is not continuing until there is another PIP recorded assessment. I'm not sure it will make any difference, but I would try. It is also useful information should you want to make another complaint and or lose an MR and go for an appeal.
2) You can go for the MR, but if you choose this, you should say that you are doing it to ensure that your son has some money coming in, but that you don't like it at all. Before you decide on this option, make sure that you are satisfied with the information that you provided on his PIP form. Look at our guide and see that you're happy with what you originally said and that you can easily refute the unusable report. You also attach a copy of your complaint which was upheld.
3) You can put in a complaint to the DWP about being penalised. This will be deal with separately from your case. You may well not have the energy having done it once, but in my view, they should be compensating you for something that in no way is your fault.
4) I don't know what your MP is like, but I think it is worth contacting them and saying what has happened. Some MPs have been quite helpful in pushing forward a case. They certainly need to be aware of cases such as yours.
What do you do next? I can't tell you what to do here. It is one of those decisions that are personal to you and you'll probably keep chewing over whether you have done the right thing. It usually comes down to getting the award and the money in your son's bank.

I have done all of the above this morning.. Been on the phone for 4 hours to various departments and a case manager who was more confused then I was!!
I've just had a answer message to contact IAS so they can offer a new phone assesment (Recorded) .
Part of me wishes I didn't complain now as a MR would have shot this report to pieces.. And I'm terrified of a new assesment.. The last was traumatic!

I can understand why you wished you hadn't complained, but give yourself a big pat on the back - because you're a brave person to have done so. It's only by people complaining that some of their more dismal practices come to light and can be challenged.
I hope your second assessment goes well.
